Gov. Andy Beshear announced Wednesday, Oct. 7, that he has declared a state of emergency to allow Kentucky farmers and truckers to use untaxed or dyed diesel fuel on public roadways. The order would take effect Oct. 8, pending approval from the state attorney general, according to the governor’s announcement.
The governor said the measure aims to ease rising costs. According to the announcement, Beshear’s action follows an executive order from President Donald Trump loosening federal restrictions to permit tax-exempt, dyed diesel on roadways. Kentucky’s order would continue until the Iran war ends or the president’s order expires Dec. 31, 2026, whichever comes first.
Kentucky Agriculture Commissioner Jonathan Shell had sent Beshear a letter urging an energy emergency declaration to help farmers during the 2026 fall harvest. Shell requested permission to use untaxed diesel for the limited purpose of harvesting and transporting agricultural products through the harvest season.
In his letter, Shell identified KRS 138.502 as the state law prohibiting untaxed or dyed diesel on public highways. He argued that Kentucky’s emergency powers law would allow Beshear to suspend that prohibition with the attorney general’s consent.
Shell also pointed to actions by governors in Texas, Nebraska and Louisiana. He said reducing agricultural transportation costs could benefit farmers and consumers, arguing that those costs contribute to food prices.
