Hyperscale data center developers are eyeing a potentially massive, controversial sales tax break passed by Kentucky state lawmakers, but they might have to meet a number of requirements recently outlined by a state board to get it.
The Kentucky Cabinet for Economic Development published new policy documents Monday afternoon detailing these new hoops for data center developers to jump through before receiving a sales and use tax break on data center equipment that can last, depending on the investment by the data center developer, for up to 50 years.
Those requirements include data center developers providing the state with an independent economic impact study, getting community buy-in through providing letters of support from local elected officials and having the data center developer say how much taxes it would have to pay without any tax breaks.
The policy documents — one an overview and another detailing the approval process — cite Democratic Gov. Andy Beshear’s executive order seeking to implement data center impact protections as the reasoning for providing the “additional policy recommendations”.
The documents also appear to leave open the possibility of state officials reducing the size and timespan of the tax breaks. That depends on if the data center developer meets economic development goals including job creation commitments, or if the developer is already receiving local tax breaks, such as through industrial revenue bonds issued by a county.
To get the sales tax break, data center developers have to receive approval from the Kentucky Economic Development Finance Authority, which meets regularly every month to approve state tax breaks and other business incentives. A Cabinet for Economic Development spokesperson did not immediately provide a response to emailed questions by the Lantern about the new policy documents.
During an Oct. 29 press conference, Beshear told reporters the state’s latest policy on the tax break would “evaluate whether it’s fair, how much of a tax break it’s giving, and to potentially reduce the state incentive by a certain amount based on that.”
“We want each of these to be fair. We do believe we’re going to have to look at them individually,” Beshear said, mentioning each project proposal can be different. “This is entirely new to us, so we’re trying to go about it in a very rational way, but one that again empowers communities.”
Beshear said data centers are “an intensely local decision” and that communities should be able to decide whether to deny them or accept them. He has previously said he doesn’t believe data centers should receive any incentive.
Earlier this year, the progressive think tank Kentucky Center for Economic Policy estimated Kentucky could miss out on billions of dollars of tax revenue from the sales tax break if applied to just a few large data centers.
Jason Bailey, the executive director of that think tank, told the Lantern the policy documents appear to put into action Beshear’s executive order, along with the possibility of scaling back the size of the tax breaks. But he still sees a need for the Kentucky legislature to act on the issue when they meet again next year.
“This would not excuse the need for the General Assembly to come in and pass legislation that actually creates mandates for local participation, for taxes being paid, for employment being created and that scales back what is a really enormous tax break,” Bailey said. “All the cabinet can do is try to negotiate the terms, but their powers here are ultimately limited.”
Bailey said the policy documents would provide helpful information to the cabinet, but he also believes such information should be made available to the public, subject to the state’s open records law, as well.
In 2025, the GOP-controlled state legislature passed a law expanding the tax break opportunity, known as the Qualified Data Center Program, to apply to hyperscale data centers developers looking to build across the state as a potential economic development boon.
Since then, the statewide tax break has garnered strong pushback and criticism from residents in Kentucky communities where hyperscale data centers are being proposed, those residents having concerns about environmental impacts and rising utility bills.
Amid the criticism over the state sales tax break, some Republican state lawmakers have suggested rolling back the sales tax break for data centers. The primary sponsor of the bill that expanded the sales tax break statewide, House Majority Whip Jason Nemes, R-Middletown, in a campaign ad said he would continue pushing for electricity ratepayer protections against data center impacts.
A spokesperson for the GOP caucus in the Kentucky House of Representatives did not immediately provide commentary on the policy documents. A spokesperson for the GOP caucus in the Kentucky Senate declined to comment.
The Kentucky Economic Development Finance Authority discussed updates to the sales tax break program during its Oct. 29 meeting.
Some Kentuckians with data center concerns attended that meeting including Max Moran, the executive director of the group We Are Mason County. That group is suing the county over the local planning and zoning process that’s made way for a planned hyperscale data center campus being built in the county by the technology company Meta.
Moran said he was glad to see the policy documents included various protections, saying members of his group had productive conversations with the cabinet at the meeting.
Community Benefit Agreements negotiated between data center developers and county fiscal courts for Mason County and Carroll County also indicate that developers plan to seek the state sales tax break, such agreements requiring that the county governments support those efforts by developers.
“If they go through and they don’t live up to what they promise and everything, then that board, with the state’s backing, would revoke their tax break exemptions for sales and use tax,” Moran said. “Which I agree with completely.”
